New VAT and Gaming Tax Rules Take Effect Tomorrow as Malta Overhauls Sector Framework

Malta’s gaming sector faces a regulatory overhaul from 1 October 2026, with clarified VAT rules and simplified gaming tax rates across all licence types.
The overhaul of Malta’s gaming tax and VAT framework becomes law tomorrow, 1 October 2026, as Legal Notices 84 and 86 of 2026 take effect.
The changes follow extensive engagement with the industry and form part of the government’s 2026 Budget commitment to safeguard the sector’s long-term sustainability and competitiveness.
Under the revised VAT framework, the treatment of sports betting and certain casino offerings has been clarified. The place of supply rules for gaming services are now more clearly defined, and operators can recover eligible input VAT costs where applicable.
The gaming tax side introduces simplified rates for qualifying activities offered to players physically present in Malta. It also consolidates the existing gaming tax and gaming device levy into a single structure based on game type and mode of offer.
The reporting transition runs on a dual track. The MGA’s portal will still accept submissions for the September 2026 reporting period under the old regime until 20 October 2026. From 1 November, the portal will support the new rules, making the October 2026 period – due 20 November – the first submission to use the updated requirements.
Both the Malta Tax and Customs Administration and the Malta Gaming Authority will issue guidance to help licensees adapt.
For operators, the clarified VAT treatment reduces uncertainty around input recovery and cross-border service classification. The consolidated levy removes a layer of administrative complexity that previously required separate filings for gaming tax and device fees.
The reforms are designed to keep Malta competitive against other European gaming hubs while ensuring a balanced regulatory environment. The government’s bet is that predictability and simplification will attract and retain licence-holders in a tightening market.
